Socorro ISD Police Officer Arrested For DWI - Socorro Independent School District | Driving While Intoxicated


A Socorro Independent School District police officer was arrested for driving while intoxicated, but school officials said there is no law that forces them to remove him from his duties, so he will continue even when students return to school on Monday.

On May 23 at 1:45 a.m., El Paso police arrested 42-year-old Sgt. Jorge Heras of the Socorro ISD police department.

"The fact that he was arrested does not necessarily mean he is guilty of what he is accused of," said Xavier De La Torre, the superintendent of SISD.

A police report obtained by KFOX 14 states Heras was driving a pickup truck on the 1800 block of Robert Wynn Street in east El Paso when an officer spotted Heras going 44 mph on the 35 limit street. Officials from the District Attorney's office told KFOX 14, the officer reported Heras smelled like alcohol, had glossy eyes, failed a field sobriety test, and refused to take a breathalyzer test.

"We keep in mind that our employees are also citizens and people outside out of work," said De La Torre.

He said they won't be taking any action until the end of Heras', for now, unscheduled trial.

"Once we determine the judicial system has arrived at a conclusion at his guilt or innocence we always take the appropriate action," he said.

When asked if he will still be around students, De La Torre said, “he may be around students."

According to the El Dorado High School website, Heras is a school resource officer on campus. SISD’s website states that it means he provides law-related educational programs in the schools, in an effort to reduce crime, drug abuse, violence and provide a safe school environment. The position also requires the Sgt to act as a role model and resource for students and staff.

"Do you really want him acting as a role model for students?” KFOX 14 asked De La Torre. “I do. I want him to act as a role model for students. Do I believe someone convicted of driving under the influence is not a role model for students? I think it demonstrates poor judgment, but he hasn't been convicted," he answered.

One recent graduate of the school who didn't want to be identified feels differently.

"He should be pulled out of the school," she said.

KFOX 14 contacted Heras' defense attorney, Teresa Caballero, but has received no call back. Heras is scheduled to be back in court Aug. 15.

If convicted Heras faces a punishment of up to 6 months in and jail and up to $2,000 fine. Read More

Conroe man handed 55 years for 8th DWI | Gliddon William Davis, District courth Judge Kathlee Hamilton - Driving While Intoxicated


Previously convicted of seven DWIs, Gliddon William Davis, 73, of Conroe, was sentenced to 55 years in prison for the felony offense of Driving While Intoxicated – Third or more.

The jury of 359th state District courth Judge Kathlee Hamilton needed less than two hours Wednesday night to find Davis guilty, and that he also used his vehicle as a deadly weapon. Because of Davis’ extensive history, his penalty range from enhanced to 25 years up to life in prison.

On Sept. 1, 2009, Michael and Tracy witnessed Davis’ driving first hand. Driving on FM 1485 in New Caney, the Allens watched as Davis weaved all over the road, ran stop signs, almost hit mailboxes and garbage cans, and forced other others off the road.

Davis’ driving was so threatening, Tracy Allen, a Montgomery County employee, attempted a citizen’s arrest.

While detaining Davis, Tracy Allen observed several signs of intoxication, confirming her suspicions. Davis had slurred speech and “smelled like a bar,” according to a district attorney press release.

Allen tried to remove Davis’ keys from his car’s ignition, but sped off with her arm still reaching for the keys. Allen was tossed from the moving caravan, and moments later Davis bottomed out in a ditch.

“I commend the valiant actions of the Allens, who stopped Mr. Davis before he killed himself or someone else,” said Brett Ligon, Montgomery County District Attorney. “We are all safer with Mr. Davis, a violent criminal with a a flagrant disregard for public safety, behind bars for the rest of his life.”

Texas Department of Public Safety Trooper William C. Smith found Davis stumbling as he walked. Because of Davis’ age and the fact he wore a prosthetic leg, the trooper could not perform all field sobriety tests. Still, Davis displayed numerous signs of intoxication

Smith also found seven empty, 16-ounce beer containers scattered near Davis’ driver’s seat. Davis told the trooper he began drinking a half-hour after leaving Victoria, and continued to drink the 160 miles to New Caney.

A sample of Davis’ blood obtained by a registered nurse and analyzed by a forensic scientist showed Davis’ blood alcohol was 0.19, which is more than double the legal limit of 0.08.

In addition to the previous DWI convictions, Davis had two counts of attempted rape, one assault with intent to commit rape and other felonies. It took the jury one hour to reach the sentence. He will not be eligible for parole until the age of 100. Read More

Rockabilly Musician Chadd Thomas Found Dead In South Austin | Austin American-Statesman and KVUE


The Austin American-Statesman and KVUE are both reporting that the Travis County Medical Examiner has ruled Thomas' death a homicide from blunt force trauma.

Rumors ran rampant across Facebook last night reporting the death of Austin rockabilly bandleader Chadd Thomas of Chadd Thomas and the Crazy Kings. Thomas originally formed the band in Houston, and was a frequent performer at the Continental Club here. He was born in Birmingham, Ala.

Jessica Vess of Austin's KVUE reported via Twitter this morning that the Austin Police Department has identified a body found Monday morning on South Congress Avenue near Oltorf as Thomas, whose real name was Charles Thomas II.

Austin police were alerted to a body slumped against a fence along South Congress around 7:45 a.m. Monday, KVUE reported. Monday night, Austin rockabilly band (and former Houstonians) the Hotrod Hillbillies posted the following message on their Facebook page:

We are very Shocked to have learn [sic] that a fellow Rockabilly Musician Chadd Thomas, was found dead this morning in South Austin. Cops are calling it a Homicide. Our thoughts and prayers go out to his family, daughter, and all the members of The Crazy Kings, especially our brother Dylan Cavalier. We hope answers of his death will come quickly.

Although homicide detectives are involved, Austin police said when they found Thomas' body that determining a cause of death was premature: "Right now, all we have is a deceased person," APD Sgt. Keith Bazzle told KVUE.

Seeking more information, Rocks Off contacted some Houston musicians who were familiar with Thomas. One, who asked not to be named, said Thomas, 38, was struck by a car following an altercation after his band's show at The Crow Bar in Austin Saturday night, and refused his friends' efforts to take him to the hospital. Ed. Note: The Crazy Kings played The Aviary Decor, another South Austin bar, Saturday night, not The Crowbar.

Houston rockabilly promoter Edgar Salazar, known as "Big E," called Thomas a "great friend" and said he is planning a tribute at next weekend's two-day Rock Baby Rock It festival. He did not remember the last time the Crazy Kings played the Continental Club.

Besides the Hotrod Hillbillies, musicians including Scott H. Biram, Back Porch Mary, Houston's 13 Black Coffins and San Antonio venue Sam's Burger Joint posted tributes to Thomas on Twitter. "Miss Melane & 13 Black Coffins will always remember how awesome you were to us," the Coffins said. Read More

Obama U.S. Attorney Nominee David Barlow Is Tea Party Senator's General Counsel | David Barlow , U.S. Attorney , Utah U.S. Attorney


Presidents routinely choose party loyalists as their U.S. attorneys. But normally, they choose nominees from their own party.

President Barack Obama dismayed fellow Democrats on Tuesday when he announced his pick to be the next U.S. attorney for Utah is David Barlow, currently the general counsel to freshman senator and Tea Party favorite Mike Lee (R-Utah).

It's unclear whether Barlow shares Lee's more extreme legal theories about the limits of federal power. But what is known about Barlow is that he has no significant criminal law experience -- he was a corporate lawyer practicing pharmaceutical defense, toxic tort and product liability law before starting to work for Lee in January -- and he's a registered Republican who contributed $300 to Obama's opponent, Sen. John McCain, in 2008.

Todd Taylor, executive director of the Utah Democratic Party, said his group sent the names of several strong, qualified Democratic candidates for the job to the White House, then never heard anything back.

"We're just deeply disappointed" by the Barlow nomination, Taylor said, "and given the legal philosophy of Mike Lee, it leads us to wonder what this guy even thinks about the law."

The liberal ThinkProgress blog suggested that "Lee's contempt for the Constitution raises serious concerns about Barlow’s fitness to serve as Utah's top federal attorney."

All in all, Taylor said, the nomination "just raises a bunch of question about why."

One answer is that Obama's leeway when it comes to successfully nominating U.S. attorneys and federal judges is severely limited by intransigent Republicans -- and by Senate Judiciary Committee Chairman Pat Leahy (D-Vt.). The Vermont senator has insisted that either senator from a nominee's home state can block the nomination simply by refusing to signal support.

The end result is that Obama, in many cases, is working off a list of candidates drawn up and considered acceptable by Republicans, rather than the other way around.

"It's impossible for President Obama to nominate somebody who doesn't have the support of the home-state senators because they won't have the ability to move through the process," said Caroline Fredrickson, executive director of the left-leaning American Constitution Society.

And some Senate delegations, she said, "are extremely ideological and don't consent to the idea that elections matter and that the president should have a prerogative in filling these positions."

Barlow was recommended to the White House by Lee and the senior senator from Utah, Republican Orrin Hatch. He also made it through a vetting process led by the Justice Department that includes extensive interviews.

White House officials defended the move: "The President looks for United States Attorneys who will faithfully discharge their duties as the chief federal law enforcement officers within their particular jurisdictions," White House spokesman Eric Schultz wrote in an email to The Huffington Post.

"Those duties include the prosecution of criminal cases brought by the Federal Government and the defense of civil cases brought against the United States," Schultz continued. "The President is confident that Mr. Barlow will exercise his discretion to further the priorities and needs of the citizens of Utah in an manner consistent with this Administration's priorities."

A former colleague at the Chicago-based law firm Sidley Austin, where Barlow worked for a decade before coming to Washington, described Barlow as conservative, but "anything but radical."

"His approach to politics is certainly mainstream," said Michael Davis, secretary of the firm's executive committee, who said he stays in close touch with Barlow.

"I think the fact that he is general counsel to Mike Lee rightly leads people to conclude that he is conservative in his approach toward politics," Davis told HuffPost. "But he has an open mind and he listens to both sides of an issue."

Lee's office said Barlow would not be available for comment.

Hatch's office had no comment but to pointed to a statement in which Hatch called Barlow "a brilliant attorney with solid Utah values and sound judgment."

Emily Bennion, a spokeswoman for Lee, said Lee would have been willing to approve a Democrat: "The senator would have made his decision based on the individual, and not on his party affiliation," she said.

The White House seriously considered another candidate last year who had the approval of both Utah's Democratic congressman and Hatch, but that candidate dropped out during the vetting process.

This isn't the first time Obama has defied state Democrats in order to find a nominee acceptable to a state's Republican senators -- though it may be the first time the process has ended with a Republican getting the nomination. As the Main Justice website reported, Obama nominated four U.S. attorneys for Texas in June, all of whom had support from the state's two Republican senators, John Cornyn and Kay Bailey Hutchison. But two did not have the support of Texas Democrats, including Rep. Lloyd Doggett.

Doggett told the Houston Chronicle the White House had assured Texas Democrats that they would be consulted. "The administration has disregarded its previous agreement and our hope for more change in the Texas justice system after decades of total Republican domination," he told the Chronicle.

Obama is just now filling the last of the 93 U.S. attorney positions around the country.

The appointment process could have gone more quickly had Leahy followed the lead of his Republican predecessor -- none other than Hatch -- and treated home-state senators' objections as merely advisory.

But Leahy spokeswoman Erica Chabot said the senator strongly supports the practice of respecting home-state senators' objections. "[Leahy] thinks it is the right one because it encourages consultation between the [White House] and home-state senators," she said.

While presidents typically replace their predecessors' appointed U.S. attorneys with ones who share their own legal philosophies, attorneys are expected to enforce the law in a nonpartisan manner.

Law enforcement is allowed to collect a blood specimen from a driver in any DWI when the driver refuses to submit to a breath or blood alcohol test and the officer obtains a search warrant from a judge to take blood. The police also have the authority to take blood without a warrant if you are arrested for DWI, you refuse to voluntarily take a breath or blood test, you caused an accident, and any individual died or suffered serious bodily injury.

Senate Bill 338 expands that authority by allowing the police to forcibly take blood without a warrant when a person other than the driver suffers bodily injury (which includes just a complaint of pain) as a direct result of an accident and the injured person has been transported to a hospital or medical facility for medical treatment. "Austin Attorney That Helps College Students": Seedling Foundation Awards Scholarships to Future College Students


Three Austin eighth grade students have been awarded $5,000 college scholarships to help them fulfill their dreams of the future.

The Seedling Foundation recently announced the winner of the 2011 Seedling College Scholarship, sponsored by the Austin employees of Cadence Design Systems, Inc. Raneesha Joiner, a student at Webb Middle School, was selected by the Cadence employees as their beneficiary.

Winners of two additional Seedling College Scholarships, sponsored by the Rourke Family, are Adrian Davila of Bedichek Middle School, and Di'Amante' Estes of Kealing Middle School.

These scholarships may be used at a two-year or four-year college or university of the student's choosing.

At the Seedling Foundation Mentor Appreciation Event on May 26 at the Delco Activity Center, the Webb Middle School students who won the very first Seedling College Scholarships in 2007 received their awards. They are graduating from high school and beginning college this fall. Ms. A'shanta Carroll will attend Austin Community College, and Ms. Zaira Ruth Garcia will attend the University of Texas at San Antonio.

Kali´ P. Rourke is President of the Seedling Foundation Board. She and her husband Dan established the Seedling College Scholarships in 2007 to assist students who are involved in the foundation's programs in reaching their educational goals.

The Seedling Foundation supports public schools by building community. In addition to a mentoring program which serves more than 350 children, it also improves campus facilities through landscaping and beautification initiatives. The foundation was established in 1998 as the Travis Community Education Foundation and was renamed the Seedling Foundation in 2007.

San Antonio police officer Michael Thornton endured two deployments to Iraq as a soldier. He survived a blast from an improvised explosive device in 2006 that sent him to Brooke Army Medical Center with second- and third-degree burns. He almost lost his life in the line of duty on the streets of San Antonio. It wasn't an assailant with a gun who almost killed Thornton early one Saturday morning in January. Instead, according to police reports, it was a suspected drunken driver who plowed into Thornton's cruiser as he was assisting stranded motorists on an elevated downtown freeway, briefly pinning him between the two vehicles, then propelling him over the guardrail.

Thornton's strength and presence of mind kept him holding on to a guardrail to avoid what would likely have been a fatal fall until the motorists he was helping pulled him to safety. He lost his foot in the impact. Now doctors at BAMC are struggling to save his lower leg. The incident that altered and nearly ended Thornton's life is not unique. In 2009, Texas led the nation in DWI fatalities with 1,269 alcohol-related traffic deaths. Of those, 51 occurred in San Antonio.

The San Antonio Police Department has become much more aggressive in dealing with drunken drivers. Chief William McManus told the Express-News that officers made twice as many DWI arrests in 2010 than they did in 2009. District Attorney Susan Reed has also declared every weekend of 2011 will be a “no-refusal” weekend, meaning drivers suspected of being intoxicated who refuse breathalyzer tests will face mandatory blood draws.

But arrests don't necessarily keep drunken drivers off the road. A backlog of DWI cases in the state court system, with more than 6,000 cases pending in Bexar County, means many drivers are delaying or evading justice.

It's not clear if that was a factor in the Thornton case, though the driver charged with intoxication assault in the incident had two prior DWI charges on his record. According to the Texas Department of Public Safety, 78,000 Texas motorists have three or more DWI convictions.

If leaders in Austin want to address an emergency issue other than the budget, then modifying the state's DWI laws — including a proposal from Mothers Against Drunk Drivers to require ignition interlock devices for first-time offenders — would be a good place to start. Drunken drivers represent serious threats to public safety, but increased fines and penalties aren't necessarily the answer.

Laws that keep drunks from getting behind the wheel offer more promise in dealing with the problem.

What is shocking about the incident that seriously injured Thornton is that it showed how great a menace impaired drivers are to everyone. If a police officer and his cruiser on the side of the road can be struck square-on, then anyone can be struck anywhere.

There are nearly 1.5 million Driving While Intoxicated (DWI) arrests each year in this country, making impaired driving one of the most frequently committed crimes. Austin , Texas modified their DWI program in 1999. A key feature of Austin ’s program was the development of a full-time team of DWI “specialists.” These officers patrol the streets in two-person teams, looking for impaired drivers. They are also available to assist general patrol officers in processing DWI offenders thus relieving the burden on those officers so that they can return to their patrol duties.

Austin ’s program includes enhanced training for officers in DWI enforcement. Rookie officers now accompany members of the DWI team for four weeks to gain hands-on experience in identifying and processing DWI suspects. The unit is under the direction of the Traffic Administration Section.
The enforcement team, is comprised of eight patrol officers and one sergeant, and concentrates its patrol efforts on detecting and apprehending impaired drivers. Each officer assigned to the DWI enforcement unit receives training in administering the Standardized Field Sobriety Tests. They also became certified Intoxilyzer operators, and several have completed a drug recognition course.

While all APD officers receive DWI enforcement training at some point at the APD police academy, many officers have not had recent experience in handling the complicated processing required by this type of arrest. A training videotape was utilized by the Traffic Office to brief all officers assigned to the task force on the proper DWI enforcement procedures. The supervisors of officers requiring additional training notified the Traffic Office for additional training assistance. All DWI task force officers work in uniform and drive marked police units.

The dedicated unit concentrates enforcement efforts on areas where DWI offenses are most likely to occur (e.g., entertainment areas featuring bars and nightclubs) during times when most impaired drivers are on the road (i.e., evenings, weekends and holidays). Typically, the DWI units are dispersed throughout the city, but at times saturation tactics are utilized. In addition to initiating their own alcohol-related arrests, members of the Enforcement Team provide support to regular patrol officers during peak offense times, relieving patrol officers by handling the lengthy processing of DWI arrests.

If asked to assist in a supporting role, the special officer may supervise the process, or may advise at certain points, such as validating the HGN results. Or, if asked, the special officer may completely take over the arrest, which allows the general patrol officer to return to service quickly. In this case, the initiating officer would then be responsible for writing a supplement to the DWI unit officer?s report. The supplement to the main report contains the reasons why the general patrol officer stopped the vehicle, what was observed and that the process was turned over to the DWI unit. If there is not a sober occupant in the vehicle to drive it, the general patrol officer may wait for the police wrecker to tow the vehicle.

The entire DWI enforcement unit works every Friday evening. The unit is split with half working Tuesday through Friday evenings, and the remaining working Wednesday through Saturday evenings. The shifts are rotated every four weeks. Reportedly there is a low turnover rate within the unit and several officers have been with the unit for four years. The DWI enforcement unit is not an assigned unit, meaning APD officers must apply for any open positions. The current sergeant for the unit reports that officers serving on the Unit are passionate about making arrests. DWI arrests are one of the few areas in law enforcement where the arresting officers can follow a case from arrest to adjudication.

While all APD officers have, at some point, received training on detecting and arresting DWI offenders, many have not actually handled this type of arrest, or at least not recently enough to feel comfortable about properly handling the complicated procedures and paperwork. If this is the case, general patrol officers, upon stopping a suspected impaired driver, may elect to call in a DWI special enforcement unit officer to support or handle the arrest process. Or new officers with less experience, who do want to handle the arrest, may need assistance, because during the time that rookie officers initially spend riding with training officers, they may never encounter a DWI. When they eventually do detect and stop a DWI suspect, enough time may have passed since their academy training that they may wish to have an experienced DWI officer present to offer guidance and assistance.

In fact, in August 2002, a new aspect of the cadet training program began in an effort to expose new officers to the actual DWI arrest process. Under this program, each area commander sends one rookie officer per week to the DWI unit for a three-week assignment. The first week, each cadet rides with a DWI unit officer and observes procedures and reviews their skills in ad-ministering the roadside tests. On the second and third weeks of their temporary assignment, they ride alone but work with the DWI unit taking hand-off arrests and making some of their own DWI arrests. Therefore the cadets, while learning proper procedures, strengthen the number of officers serving on the DWI unit. The fourth week they report back to their shift at their as-signed area command. By this time, they are familiar with apprehending and processing their own DWI offenders and with taking hand-offs from fellow officers in their area command. This training program should help to maintain, and perhaps further increase, the number of DWI arrests.

DWI Arrests

The number of DWI arrests had been trending down from about 3,500 in 1990 to only 2,200 in 1996, and had been holding steady from 1994 through 1997.
With the start of a part-time DWI task force in 1998, arrests increased to 4,077, an increase of 48 percent over the 2,747 arrested for DWI in 1997. A further increase to 4,500 occurred in 1999 during the transition from the task force to the full-time DWI unit. The arrest rate remained at a high level in the following two years, with only a slight dip in 2001.

Convictions

Conviction rates for DWI cases adjudicated in county courts in Travis County (where Austin is located) increased from approximately 70 percent in 1996 to 77 percent immediately after the start of the program. This 7 percent increase in conviction rates remained in effect through the year 2001.
